1. Air transportation and transfers are included in the price of the tour. Visa, airport departure taxes and fees are not included, and are the responsibility of participant. At the time this agreement was printed, visa fee to enter Bali was $25 and departure tax from Bali was $20. These fees may be increased by the Republic of Indonesia without notice.

2. Passport information will be required to issue airline tickets. Each participant must have a passport with validity of at least six months from the date of the return flight or Singapore Airlines will not issue tickets. Should a participant fail to have such a passport and the airline refuses to issue a ticket, such failure will be deemed a voluntary cancellation and the cancellation fees listed below will apply. Seats are assigned at the discretion of the airline, and may be changed by carrier without notice.

3. Airline fares are based on transportation for a specific date. Any change by participant will be deemed a voluntary cancellation and will incur the cancellation fees listed below unless the change involves extension of the tour, payment for such extension and written approval of such change by OTMT. The passenger ticket is the sole contract between the participant and and the airline.

OTMT does not take responsibility for lost or damaged baggage. At the time this agreement was printed the free baggage allowance was two checked bags; the sum of the three dimensions (length+width+height) of each may not exceed 62 inches; the sum of the three dimensions of both pieces may not exceed 107 inches. The weight of each may not exceed 44 lbs. In addition, one carry-on bag not exceeding 15 lbs or 45 inches in overall dimensions is allowed. Excess baggage charges will be participant’s responsibility, and as they are substantial we urge everyone to observe the free baggage allowance limitations.

1. All prices are based on air fares, exchange rates and accommodation prices prevailing in October 2006, and are subject to increases by, but not limited to, airlines, hotels, ground services and increases in fuel costs and/or changes in currency exchange rates. No refunds will be made for any transportation, land accommodation or service or any other feature of the tour not used by participant.

2. If due to weather, flight schedules or other factors, participants are required to spend additional nights on the tour, participant will be responsible for the cost of his/her hotel, hotel transfers and meals.

Gratuities for meals sponsored and paid by OTMT are included. Should participant receive outstanding service, an additional tip is not inappropriate. Gratuities for drivers, guides or other Personnel are at the discretion of the participant.

At the time notice of cancellation is received from participant by OTMT the following cancellation fees will apply:

Cancellation prior to 121 days before departure- $100 administrative fee; Cancellation between 120 and 91 days before depature-20% of the tour price; Cancellation between 61 and 90 days before departure -50% of the tour price; Cancellation within 60 days before departure-100% of the tour price.

The airline fares, hotel rates, meals and surface transportation are based on group rates, the availability of which depends upon the number of tour participants. If in the sole judgment of OTMT the minimum number will not be achieved to secure such group fates, it may cancel the entire tour without penalty or liability. In such event, OTMT will notify participants at least 60 days before departure. Upon such cancellation, OTMT will remit 100% of the tour price including the administrative fee within a reasonable time after deposits to reserve space have been received by OTMT from the vendors.

OTMT strongly recommends trip cancellation/emergency medical evacuation/baggage/accident and sickness insurance. We will send participant a brochure from Travel Insurance Services. Alternatively, he/she may select any other insurance company.

Participants must be in good health. This tour involves walking over uneven surfaces, up and down steps and entering and leaving vehicles. Participant certifies that he/she has no condition that would create a hazard to him/her or to other participants. The right is reserved by OTMT in its sole discretion to refuse acceptance or retention of any person as a member of this trip at any time.

OTMT, its officers, directors, employees and agents (individually and collectively “OTMT”} do not own or operate any entity on this tour such as airlines, buses, cars, lodging, ground operators, etc. All such entities are independent contractors. OTMT assumes no responsibility nor liability for any aircraft or other conveyance, nor for neglect or default by any subcontractor or other third party. Nor will OTMT be responsible for losses, damages or expenses to persons or property due to illness, disease, injury, weather, strikes, local laws, hostilities, wars, insurrections, riots, terrorist acts, acts of God, force majeure, overbooking or downgrading of accommodations, mechanical or other failure of any transportation entity to arrive or depart on time, or such other causes beyond its reasonable control. Further, OTMT is not responsible for transportation or other delays or changes, nor additional expenses or loss of time that may be incurred thereby. During the past decade the U.S. State Department and other agencies have from time to time issued warnings of potentially hostile acts against tourists in Indonesia and Bali. Those notices are available on the internet or through direct correspondence with the relevant department or agency. We urge participants to read them before making reservation for this tour.

Should a dispute arise between participant and OTMT, it will be resolved by binding arbitration under the rules of the American Arbitration Association, which arbitration shall be conducted in Sarasota County, Florida. The maximum recovery to which a participant shall be entitled under any and all circumstances will be the sum of all monies received by OTMT from the participant. The participant agrees that this is a fair limitation on the damages that a participant may claim against OTMT.

Upon downloading and signing this agreement, participant agrees to be bound by its terms and conditions.
